Areas of Practice in Family Law
As family dynamics have changed, the practice of family law has evolved. The term family lawyer might once have been considered synonymous with divorce lawyer, but it now involves much more, as our areas of practice show:
- Marital Breakdown. Covering all manner of relationship breakdown, including marriage, common law and same sex relationships, our services include separation agreements, contested and uncontested divorces, and financial support. We will also help you reach fair agreements for dividing the contents of the matrimonial home.
- Cases Concerning Children. In cases of separation and divorce, we will see that fair and equitable child custody and visitation agreements are made. We will also ensure that adequate financial support is obtained for all children. Where necessary, we will represent your interests before the Family Responsibility Office. Our work on behalf of children also includes child protection proceedings.
- Pre–Nuptial, Marriage and Other Contracts. Pre–nuptial agreements (signed before a couple marries) and marriage contracts (signed before or after the marriage occurs) can define which property you brought to the relationship and how property will be divided in the event of a separation or divorce. Cohabitation agreements perform a similar function for couples in common law relationships. Our lawyers can advise you and draft a mutually agreeable contract for you and your spouse.
- Adoption, Surrogacy and Related Issues. Before you begin adoption proceedings or enter into an arrangement for surrogacy or egg/sperm donation, you need to know your legal rights and obligations. We will discuss with you the details of the relevant Canadian laws, contained in the Assisted Human Reproduction Act, and work closely with you to see that your interests are protected.
- Alternative Dispute Resolution. To make negotiations and discussions friendlier and more constructive, we may suggest alternative solutions like mediation and arbitration for your case.
