Divorce is one of the most stressful events one could experience in one’s lifetime.  Indeed, some might say that divorce is like a death in the family.

  • Child Custody: where will the children reside  on a full–time basis and who will be making the major decisions on their behalf;
  • Access:  the rights of the children to spend time with the parent that does not live with them;
  • Financial Support for the Children;
  • Division of property: with respect to houses, pensions from employment, RRSPs, investments, bank accounts and cash and even pets;
  • Family Property:  who will stay in the family home, or will it be sold;
  • Debts:  who will bare the responsibility of the any family debts, or how will it be divided.

The above stipulations can also be prepared within the context of a Separation Agreement, which Heydary Hamilton PC can also help with and then include in the divorce judgement. Agreements are treated stringently by the courts, and are often considered to be wholly binding, as such it is recommended that you seek legal advice with respect to the preparation and negotiation of any domestic agreement.
