In Bourdoukis (Swiss Precision Wire Cutting and Tool and Die Company) v. Kanda, 2011 ONSC 4283, the Honourable Justice Allen granted the defendant’s motion for summary judgment to enforce the settlement of the underlying action pursuant to a full and final release executed by the plaintiff, Spyros Bourdoukis. In her reasons, the Honourable Justice Allen, finds that the plaintiff has not satisfied the factors set out in Grixti v Kingston (City), [2010] O.J. No. 4022 (Ont. S.C.J.), failed to establish the basis for a finding that the release should be set aside, and thus has not demonstrated that there is a genuine issue requiring a trial.
