Canadian Patent Office offers expedited examination for Green Technologies

As of March 3, 2011, the Canadian Patent Office has offered expedited examination for patents involving green technologies.  Under Paragraph 28(1)(b) of the Patent Rules, the Commissioner may expedite the prosecution of an application when the invention is related to green technology. At this time, to obtain expedited examination, a written request in this regard must be filed in the patent office. Expedited examination however, is not available for all patents. In particular, if an application is abandoned and not reinstated as of April 30, 2011, then expedited examination in this regard is not available. Moreover, expedited examination is not available if the Commissioner has already extended time for doing anything in respect of the application under Rule 26(1).
